Terms and Conditions

§ 1 Scope

These Terms apply to the use of ForeverPix services, including the website, app, event galleries, invitations, QR tools and Premium features.

The contracting party is ForeverPix, Markus Müller, Wallenfels, unless the legal notice states otherwise.

§ 2 Services

ForeverPix provides tools to create and manage private event galleries, invitations, guest lists, seating plans, messages, menus and QR templates.

The exact scope depends on the selected free or paid plan. We may improve features as long as the core purpose of the service remains available.

§ 3 Account and Use

Host features may require a user account. Registration data must be accurate and login credentials must be kept confidential.

Users may only use the services lawfully and must have the necessary rights to upload and share their content.

§ 4 Content and Rights

Users retain all rights to their photos, videos, text and other content. They grant ForeverPix only the rights technically required to provide, store, process, display and share the service with authorized guests.

We do not commercially use user content beyond the service without separate consent.

§ 5 Premium, Prices and Payment

Paid features may be purchased through the app stores or, where offered, through our website. Displayed prices include applicable taxes unless stated otherwise.

Purchases via Apple App Store or Google Play are also subject to the payment, tax and billing terms of the relevant store.

§ 6 Refund Policy and Withdrawal

Refunds are granted only where required by law, where a technical defect exists, or where these Terms expressly provide otherwise. Mandatory statutory rights remain unaffected.

• Apple App Store purchases: refund requests generally must be submitted through Apple or reportaproblem.apple.com.
• Google Play purchases: refund requests generally must be submitted through Google Play or the relevant Google account.
• Website purchases: to the extent permitted by law, digital purchases are non-refundable and non-exchangeable unless a legal claim, technical defect or expressly promised refund applies.
• For technical issues, contact info@foreverpix.me and include order ID, account email, platform and suitable evidence such as screenshots or screen recordings.
• EU consumers generally have a 14-day withdrawal right. For digital content or digital services this right may expire or be restricted if you expressly consent to immediate performance and acknowledge that you lose the withdrawal right.
• Where a valid withdrawal is possible, we refund payments without undue delay and no later than 14 days after receiving the withdrawal notice using the same payment method, unless legally permitted otherwise.

§ 7 Prohibited Content

Content that violates third-party rights or is unlawful, abusive, discriminatory, harmful to minors or otherwise misused is prohibited. We may remove such content and suspend accounts in serious cases.

§ 8 Liability

We are fully liable for intent, gross negligence and injury to life, body or health. For slight negligence we are liable only for breach of essential contractual duties and limited to foreseeable typical damages.

Mandatory statutory liability remains unaffected.

§ 9 Privacy

Information about personal data processing is available in our Privacy Policy.

§ 10 Final Provisions

German law applies excluding the UN Sales Convention, provided mandatory consumer protection laws in the user's country of residence do not prevail.

If any provision is invalid, the remaining provisions remain effective.
