Términos y condiciones generales de negocio.

§ 1 Alcance

Estos Términos y Condiciones Generales se aplican a todos los contratos sobre el uso de los servicios y la aplicación de Foreverpix (en adelante, "Servicios") celebrados entre Markus Müller (Foreverpix) y el cliente. No se reconocen condiciones divergentes del cliente, a menos que Markus Müller acepte expresamente su validez.

§ 2 Servicios

Foreverpix provides a platform on which users can create albums, upload images, share and store them. The scope of services depends on the chosen package. We reserve the right to adapt the services to the state of the art or for optimization at any time, without affecting the core of the service.

§ 3 Registro y cuenta de usuario

The use of our services requires registration within the app. The user undertakes to provide truthful and complete information during registration. The access data must be kept secret and protected from access by unauthorized third parties.

§ 4 Contenido y derechos de uso

The user retains all rights to the content uploaded by him (photos, videos, texts). However, he grants Foreverpix the simple, spatially and temporally unlimited right for the duration of the contract to store, reproduce and display these contents exclusively for the purpose of providing the services (display in the gallery, creation of ZIP downloads). Any other use or disclosure to third parties does not take place.

§ 5 Responsabilidad

We are liable without limitation for damages based on intentional or grossly negligent breach of contract by us, as well as for damages from injury to life, body or health. For slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract in the first place.

§ 6 Disposiciones finales

Se aplica el derecho de la República Federal de Alemania, con exclusión de la Convención de las Naciones Unidas sobre los Contratos de Compraventa Internacional de Mercaderías. El lugar de jurisdicción para todas las disputas derivadas de la relación contractual es, siempre que el cliente sea un comerciante o una persona jurídica de derecho público, la sede de Foreverpix (Wallenfels).
