Termos e condições gerais de negócios

§ 1 Escopo

Estes Termos e Condições Gerais aplicam-se a todos os contratos relativos à utilização dos serviços e da aplicação Foreverpix (doravante designados "Serviços") celebrados entre Markus Müller (Foreverpix) e o cliente. Condições divergentes do cliente não são reconhecidas, a menos que Markus Müller concorde expressamente com a sua validade.

§ 2 Serviços

Foreverpix provides a platform on which users can create albums, upload images, share and store them. The scope of services depends on the chosen package. We reserve the right to adapt the services to the state of the art or for optimization at any time, without affecting the core of the service.

§ 3 Cadastro e conta de usuário

The use of our services requires registration within the app. The user undertakes to provide truthful and complete information during registration. The access data must be kept secret and protected from access by unauthorized third parties.

§ 4 Conteúdo e direitos de uso

The user retains all rights to the content uploaded by him (photos, videos, texts). However, he grants Foreverpix the simple, spatially and temporally unlimited right for the duration of the contract to store, reproduce and display these contents exclusively for the purpose of providing the services (display in the gallery, creation of ZIP downloads). Any other use or disclosure to third parties does not take place.

§ 5 Responsabilidade

We are liable without limitation for damages based on intentional or grossly negligent breach of contract by us, as well as for damages from injury to life, body or health. For slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract in the first place.

§ 6 Disposições finais

Aplica-se a lei da República Federal da Alemanha, com exclusão da Convenção das Nações Unidas sobre Contratos de Compra e Venda Internacional de Mercadorias. O foro competente para todos os litígios decorrentes da relação contratual é, desde que o cliente seja um comerciante ou uma pessoa coletiva de direito público, a sede da Foreverpix (Wallenfels).
