Condizioni generali di contratto

§ 1 Campo di applicazione

Le presenti Condizioni Generali di Contratto si applicano a tutti i contratti relativi all'utilizzo dei servizi e dell'app Foreverpix (di seguito denominati "Servizi") stipulati tra Markus Müller (Foreverpix) e il cliente. Condizioni divergenti del cliente non sono riconosciute, a meno che Markus Müller non acconsenta espressamente alla loro validità.

§ 2 Servizi

Foreverpix provides a platform on which users can create albums, upload images, share and store them. The scope of services depends on the chosen package. We reserve the right to adapt the services to the state of the art or for optimization at any time, without affecting the core of the service.

§ 3 Registrazione e account utente

The use of our services requires registration within the app. The user undertakes to provide truthful and complete information during registration. The access data must be kept secret and protected from access by unauthorized third parties.

§ 4 Contenuto e diritti d'uso

The user retains all rights to the content uploaded by him (photos, videos, texts). However, he grants Foreverpix the simple, spatially and temporally unlimited right for the duration of the contract to store, reproduce and display these contents exclusively for the purpose of providing the services (display in the gallery, creation of ZIP downloads). Any other use or disclosure to third parties does not take place.

§ 5 Responsabilità

We are liable without limitation for damages based on intentional or grossly negligent breach of contract by us, as well as for damages from injury to life, body or health. For slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract in the first place.

§ 6 Disposizioni finali

Si applica il diritto della Repubblica Federale di Germania, con esclusione della Convenzione delle Nazioni Unite sui contratti di vendita internazionale di merci. Il foro competente per tutte le controversie derivanti dal rapporto contrattuale è, se il cliente è un commerciante o una persona giuridica di diritto pubblico, la sede di Foreverpix (Wallenfels).
