Genel iş şartları ve koşulları

§ 1 Kapsam

Bu Genel İşletme Şartları, Markus Müller (Foreverpix) ile müşteri arasında yapılan Foreverpix hizmetlerinin ve uygulamasının (bundan böyle "Hizmetler" olarak anılacaktır) kullanımına ilişkin tüm sözleşmeler için geçerlidir. Müşterinin farklı koşulları, Markus Müller'in geçerliliğini açıkça kabul etmediği sürece tanınmaz.

§ 2 Hizmetler

Foreverpix provides a platform on which users can create albums, upload images, share and store them. The scope of services depends on the chosen package. We reserve the right to adapt the services to the state of the art or for optimization at any time, without affecting the core of the service.

§ 3 Kayıt ve kullanıcı hesabı

The use of our services requires registration within the app. The user undertakes to provide truthful and complete information during registration. The access data must be kept secret and protected from access by unauthorized third parties.

§ 4 İçerik ve kullanım hakları

The user retains all rights to the content uploaded by him (photos, videos, texts). However, he grants Foreverpix the simple, spatially and temporally unlimited right for the duration of the contract to store, reproduce and display these contents exclusively for the purpose of providing the services (display in the gallery, creation of ZIP downloads). Any other use or disclosure to third parties does not take place.

§ 5 Sorumluluk

We are liable without limitation for damages based on intentional or grossly negligent breach of contract by us, as well as for damages from injury to life, body or health. For slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract in the first place.

§ 6 Son hükümler

Birleşmiş Milletler Uluslararası Mal Satım Sözleşmeleri Antlaşması hariç olmak üzere Almanya Federal Cumhuriyeti yasaları geçerlidir. Sözleşme ilişkisinden doğan tüm anlaşmazlıklar için yetkili mahkeme, müşterinin tacir veya kamu hukukuna tabi bir tüzel kişilik olması durumunda, Foreverpix'in merkezidir (Wallenfels).
